Daughters of Raila lobby group coordinator Irene Mayaka will now be confirmed as bona fide nominated MCA of the party following a rigorous process.

For over seven months, Ms Mayaka has been in and out of court challenging nomination of Damaris Mouni, who also insists that she was properly nominated by the party.

A bench of appeals court judges led by Alnashir Visram ruled last week that a case involving an MCA election or nomination cannot be heard by Appeals Court.

The judgement therefore outlines High Court as the highest election court for MCA, a ruling that could also halt many cases in the country.

At first, Mayaka won in law courts before having her victory in the case affirmed by High Court in July this year.

But a determined Mouni moved to Kisumu Appeals Court to challenge the outcome but following the ruling by the five judges in the Supreme Court building, the case will automatically collapse.

Even as the judges scheduled 19th December as the delivering full judgment, Ms Mayaka is already excited with the latest development.

"It's been a long journey and God works in different ways. She has been dragging this case in court despite understanding that she lost.

"I can't wait to serve the party in the assembly. It's been so long and finally justice is here with us," she said.

When she first won at magistrate court, Mayaka was sworn in by assembly speaker Moffat Teya only to lose the privileges days later after Ms Mouni moved to High Court.

The ODM party insists that Ms Mouni is a stranger who sneaked her way to the party nomination list last year through IEBC.
