Kiambu Principal Magistrate Brian Khaemba has been suspended after handing Governor Ferdinand Waititu anticipatory bail

The magistrate, Brian Khaemba who has since been transferred to Thika Law Courts was suspended on Thursday following a directive from the Chief Justice David Maraga over gross misconduct. 

According to Maraga, the magistrate failed to adhere to the required code of conduct when he issued the bail to the first term county boss, who is currently being investigated over the loss of millions in his government. 

In a letter seen by Daily Nation, Maraga said that the magistrate had taken a sick leave only to come back and hand Waititu bail under unclear circumstances.

“It was public knowledge that Mr Khaemba was on sick leave as the same was announced to litigants during the morning briefing,” read part of the letter. 

Khaemba issued Waititu Sh500,000 anticipatory bail following his arrest. The move by the magistrate elicited mixed reactions from different quarters after it emerged that the Kiambu county boss cannot account for the funds he received from the National Treasury. 

Critics believe that the magistrate handed Waititu anticipatory bail in a bid to derail the fight against graft in the country. 

Waititu has, however, said that he is being scrutinised because of his relationship with Deputy President William Ruto.
