Milimani Anti-Corruption Chief Magistrate Douglas Ogoti will make the ruling on Tuesday at 12 noon.

Kidero and 13 other accused persons pleaded not guilty to a charge of conspiring and defrauding the Nairobi County government of Sh68 Million.

The former governor also pleaded not guilty to charges of abuse of office, money laundering, dealing with suspect property and unlawful acquisition of public property.

Kidero and others are alleged to have made illegal payments of Sh68 million to a law firm; M/S Wachira Mwangi and Company Advocates.

The Director of Public Prosecution (DPP) opposed Kidero's application for bail, saying the charges against him and other suspects are serious and they could interfere with witnesses if released on bail.

The DPP also told the court that Kidero and others could abscond trial if given bail.

Kidero's lawyers, however, rubbished the DPP's move to oppose bail, saying that he did not give compelling reasons to object to the suspects' release.

The former Governor and other suspects spend the weekend in police custody before their presentation in court on Monday.

They will be remanded at the EACC and Kilimani police station pending bail ruling on Tuesday.
