Inspector General of Police Hilary Mutyambai and DCI boss George Kinoti were on Friday a no show in a court case pitting them against former Sports Cabinet Secretary Rashid Echesa.

Echesa moved to court on Wednesday to seek answers behind his arrest and detention on Friday last week, in relation to his implication in the Matungu killings in Kakamega County.

In the case mentioned before Kakamega High Court judge Jesse Njagi, only the Director of Public Prosecution (DPP) Noordin Haji was represented by his lawyer Samson Ng'etich.

Also, absent for the hearing were Interior Cabinet Secretary Fred Matiang'i and a representative of Attorney General Paul Kihara Kariuki who has also been listed as a respondent in Echesa's suit.

The judge set the date of hearing for May 30, directing the complainant to serve DCI, AG and IG to enable them to file their responses ahead of their court appearance.

Through his lawyer James Namatsi, Echesa argued that his arrest and detention was abuse to his fundamental rights, in contravention to articles 25 and 47 of the constitution.

“We want the court to consider article 25 of the Constitution which explains fundamental rights and freedoms that may not be limited. We declare that his arrest and intended prosecutions were an abuse of the criminal justice system and a contravention of his rights," the lawyer was quoted by the Nation.

Echesa who was held for two days at the Nandi Hills Police Station was released on Sunday.
