Celebrated lawyer Ahmednassir Abdullahi has led a team of lawyers in criticising Justice James Wakiaga's bail ruling on Joseph Irungu alias Jowie.
Mr. Irungu was thrown back to prison over the death of Monica Kimani even as his fiance Jacque Maribe survived.
In a tweet, the Senior Counsel wondered why Wakiaga denied Jowie bail in a 'country with 2 per cent convictions'.
“Kenyans don't flee their country to avoid trial...with a conviction rate of less than 2% why should anyone be scared of trial in a Kenyan court...of course unless you are very POOR,” wrote Ahmednasir.https://twitter.com/ahmednasirlaw/status/1057500938812956674?s=19
Donald Kipkorir, another top lawyer, on the other hand, argued that Justice Wakiaga failed as he appeared to believe Jowie is guilty.
“Have read the full ruling of Justice James Wakiaga. With tremendous deference to him, he went beyond the threshold on rulings for Bail.
“He seems to believe Jowie Irungu is guilty & Jackie Maribe innocent. A Judge must be Courteous, Wise, Sober & Impartial," he noted.
In his ruling, Wakiaga termed Irungu 'a make version of a sly queen' or a 'woman-eater' for lack of a better terminology, adding that his access to weapons could intimidate witnesses.
Mr. Irungu and Maribe will be back to court in June 2019 for trial of Monica Kimani's murder.
