The Office of the Director of Public Prosecutions (ODPP) has confirmed that lawyer Peter Wanyama was not arrested or detained in connection with misappropriation of funds at the Mumias Sigar Company.
In a tweet, the ODPP led by Noordin Haji, noted that Wanyama, who was a former partner of Prof Tom Ojienda will be used as a prosecution witness in the case.
"ODPP wishes to confirm that Peter Wanyama, Advocate, will be prosecution witness after analyzing his statements & will testify in the case against Prof Tom Ojienda. He was neither arrested alongside Prof Ojienda nor recommended for prosecution by DCI," ODPP tweeted.

The move was not welcomed with a section of legal minds with some feeling betrayed by the advocate.
Lawyer Nelson Havi accused Wanyama of being a "Judas Iscariot".
"DCI has a damning file on Peter Wanyama relating to theft of millions from a County Government in Western Kenya, which file has not been acted upon. It does not therefore, surprise that he has been sanitized overnight from a suspect to a witness against Professor Tom Ojienda.
"Peter Wanyama is a shameless traitor and wet boy. He has been hovering around Professor Tom Ojienda and his legal team, collecting intelligence and transmitting it to his masters. He is indeed a witness in the intended prosecution of his master and mentor. Judas Iscariot reborn!" he tweeted.
