A battle is looming in Homa Bay county, after ousted Majority Leader Richard Ogindo vowed to stay put.

Speaking on Tuesday, Ogindo who was kicked out by the Members of County Assembly (MCAs) a week ago maintained that he still occupies the seat.

Ogindo who enjoys the area's dominant Orange Democratic Movement (ODM) party's backing said that he has since written to County Assembly Speaker Elizabeth Oyoo affirming his position, after the party annulled his ouster.

“I must comply with instructions of ODM, which has written a letter (saying) I am the majority leader. I am going to court because the party is solving the matter,”  he is quoted by the Standard.

The party through its Secretary General Edwin Sifuna had initially cautioned its majority members in the assembly against the move.

They, however, defied the directive and proceeded to oust him in a sitting presided over by Deputy Speaker Evans Marieba.

Ogindo was replaced with Kanyadoto MCA Walter Muok.

The Deputy Party leader seat was also shifted from nominated MCA Ruth Ombura to her Homa Nay Central counterpart Julius Nyambok.

The party has since given the members a one week timeframe to explain the action or face punitive measures.

“Your actions showed gross misconduct according to the constitution of ODM. You are hereby given notice to show cause in writing within seven days as to why disciplinary action should not be taken against you,” Sifuna said in a letter.
