Lima limited, a company linked to retired President Daniel Arap Moi and former Minister the late Nicholas Biwott has suffered a blow after losing five parcels of land in Eldoret Town.
This follows a ruling made by the High Court that the said parcels of land are public property.
Eldoret Lands and Environment court Judge Anthony Ombwayo ruled that the parcels where the High Court in Eldoret stands as well as the fire station, an Administration Police camp and the district hospital were not available for alienation as they were public property.
According to Justice Ombayo, the titles deeds held by Lima limited are null and void.
"In a nutshell, the 1st defendant (Lima limited) in procedurally obtained title to the properties in issue as the same had been alienated as Public land with public utilities and not available for conversion to private land," reads the judge's ruling as quoted by Business Daily.
Justice Ombwayo in his ruling also said the registration of Lima limited as the lessee is therefore cancelled as those parcels titles have been declared null and void.
The parcels are occupied by the High court which comprises of Children's court, Environment and Land's court, the hospital and a fire station.
The Ethics and Anti-corruption Commission (EACC) which was then Kenya Anti-corruption Commission had moved to court in 2006 challenging the title issued to Lima Limited between 1995 and 1998, arguing that it was public property, therefore, acquired illegally.
