President Uhuru Kenyatta while issuing the directive during Madaraka Day fete in Narok the window for changing the currency is until October 1.

Several leaders among them EALA MP Simon Mbugua and activist Okiya Omtatah have since moved to court to challenge the directive on the new legal tender notes.

Mutua now says that it is highly improper for a state official to sue the same government that he is working for.

"In my book, it is improper and unacceptable for a government employee or state officer at that to sue the same government over a government program of exchanging all 1000 shillings by October," Mutua said.

The Machakos Governor who has shown his interest to vie for presidency come 2022 went ahead to tell the state officers to first resign before suing the government.

"The proper thing is for one to first resign from the government. Wanaongopa nini? (What are they fearing?)," he poses.

Mbugua in his petition termed the move by CBK to distribute the new currency notes as illegal and unconstitutional because the notes bear the portrait of Mzee Jomo Kenyatta.
