Renowned city lawyer Nelson Havi has questioned Chief Justice David Maraga over his decision to suspend Kiambu Principal Magistrate Bryan Khaemba.
Havi on Friday accused Maraga of being biased and targeting Khaemba. Khaemba was suspended after handing Kiambu Governor Ferdinand Waititu an anticipatory bail in his case over misuse of county funds.
"On 28.9.2018 SPM R K Ondieki granted anticipatory bail. He dismissed the DPP’s objection that the Subordinate Court had no jurisdiction. No appeal or revision was preferred. The Magistrate was not suspended. Can CJ Maraga explain the discriminatory treatment of PM Bryan Khaemba?" he asked.
However, Havi questioned the decision of CJ Maraga in directing that Khaemba should be suspended while Magistrate Ondieki of SPM Kilifi court was never handed suspension when he granted anticipatory bail.
This is not the first time Havi, who vowed to make sure Khaemba's suspension is uplifted, is accusing CJ Maraga of his decision.
Last week, he came out citing a possible court battle with both CJ Maraga and the JSC.
"We will take on CJ Maraga and JSC on the constructive summary dismissal of Bryan Khaemba. They will lose," he said.
According to Havi, the dismissal of Mr Khaemba was a "constructive dismissal" and not following the law.
