The Director of Public Prosecution (DPP) Noordin Haji has opposed an application by former National Lands Commission (NLC) chairman Dr Mohamed Swazuri to have his bond and bail terms reviewed.
Swazuri has been indicted of among other things, abuse of office and irregular payments for compensation to landowners.
The DPP argues that the Sh30 million bond or Sh12 million cash bail slapped on Swazuri by the Anti-Corruption Magistrate Court is reasonable and should not be reviewed.
Through Senior Assistant Director of Public Prosecutions (SADPP) Vincent Monda, the DPP wants High Court Judge Mumbi Ngugi to dismiss the application or enhance the bond terms against Swazuri and other accused persons.
Justice Mumbi will make a ruling on the application on May 2.
Swazuri filed the application saying he cannot afford the Sh12 million cash bail slapped on him.
He argues that the bond terms against him are outrageous and contravenes his right to a fair bond or bail.
The embattled former NLC chairman was slapped with Sh12 million bail after pleading not guilty to charges of alleged fraudulent land compensation for the construction of Mombasa Southern Bypass and Kipevu New High Terminal link Road in October 2013.
Swazuri is said to have made irregular payments to Tornado Carriers Ltd for compulsory acquisition of land in Mombasa.
The suspects also pleaded not guilty to charges of conspiracy to commit economic crime, abuse of office, financial misconduct, money laundering and unlawful acquisition of public property.
He is charged alongside former NLC commissioner Emma Njogu, former NLC Chief Executive Officer (CEO) Tom Aziz Chavangi, Dr Salome Munubi, director of Valuation at NLC, and NLC Secretary Lilian Kaverenge.
Others are Francis Mugo, Director of Finance and Administration, businessmen Samuel Rugongo, Godfrey Muritu, Evahmary Wachera, Micahel Oloo and advocate Catherine Wanjiru.
