The protracted legal battle regarding deported lawyer Miguna Miguna has been determined by a Nairobi court.
Lawyer Nelson Havi on Friday announced in a statement that the court had ruled that Miguna is a citizen by birth.
He indicated that the court had determined Miguna never lost his citizenship by acquiring Canadian citizenship. The ruling further found that the respondents had no power to revoke his citizenship.
The High Court's Justice Chacha Mwita ruled that even if the respondents could have revoked Miguna's citizenship, that was never done procedurally.
Havi, who has been part of Miguna's defence team termed the ruling as a landmark decision on whether citizenship is an inalienable right guaranteed by the Bill of Rights or a privilege afforded by the State.
In a tweet on the court's decision, Miguna lauded his lawyers. The court awarded him Sh7 Million in legal expenses. His defense team also comprised of Dr Khaminwa Waikwa and Mamanda Mucheke.
"Justice Chacha Mwita has restated what I've maintained throughout. That the despots violated my fundamental rights, freedom and dignity and that I'm a Kenyan and never lost my citizenship," Miguna wrote on Twitter.
The court ordered the Interior CS Fred Matiang'i and PS Gordon Kihalangwa to personally pay for the legal costs. Chacha directed that costs the be Matiang'i and Kihalangwa's individual obligation so as to deter such actions by state officers.
The two are also required to pay Sh207, 000 for damages on Miguna's property.
