Homa Bay residents might be subjected to a by-election following the nullification of the county Governor Cyprian Awiti's August 8 reelection.
The governor appeared two times unlucky when the appellate court on Thursday upheld an initial High Court nullification of his election.
The petition challenging his reelection had been filed by his main challenger in the race Oyugi Magwanga, with the 3-judge bench on Thursday agreeing with the petitioner that the election was not free and fair.
Reading the ruling on behalf of the bench, Justice Fatuma Sichale ordered the Governor to pay pay a sum of 6 million shillings, with Magwanga set to receive Sh2 million of the entire sum.
According to the results released by the Independent Electoral and Boundaries Commission (IEBC) after the elections, Awiti garnered 210, 173 votes against Magwanga's 189, 060.
According to Magwanga, however, he won the race with 224, 863 votes against the incumbent's 172, 235.
