A politician from Wajir County who was assaulted last year may have a permanent disability of 30 percent.
The Makadara Law Courts heard that Wajir politician Hussein Mohamed was assaulted by Jamal Mohamed, who is also an American citizen, on September 2017 in Eastleigh, Nairobi.
Jamal who is facing charges of assault and causing grievous harm to politician Hussein is also facing charges of being in Kenya illegally.
The court heard that the accused person assaulted Hussein outside a Mosque in Eastleigh leaving him with serious injuries on his left leg.
According to a medical report by Doctor Joab Bodo tabled before the court, Hussein may have a permanent disability of 30 percent and he will have early Osteoarthritis in his joint.
Dr Bodo said that despite active physiotherapy that Hussein will receive, he will not be able to get full flexion in the left knee joint.
The court heard that Hussein was admitted at Agha Khan Hospital on December 11, 2017, and was walking with the aid of crutches with no weight bearing on the left leg.
“The last check X-ray left knee joint taken on November 23, 2018, is reported as the bone union is still progressing but not complete,” said Dr Bodo as quoted by citizentv.co.ke.
The accused person, however, filed an application to have the politician subjected to independent medical examination.
Magistrate Eunice Kimaiyo in his ruling said the medical report tabled by Dr Bodo could not be relied on because he is a personal doctor to Hussein and directed that Hussein is subjected to another medical examination.
The case will be mentioned on January 21, 2019.
