Controversial Somali lawyer Ahmednasir Abdullahi has come to the defence of a former KCSE student at Elimu Bora Secondary in Mandera who had allegedly planned to assassinate President Uhuru and Garissa Township Aden Duale.

In a social media statement, Ahmednasir said the student should be released unconditionally since written fiction is not a criminal offence. 

The lawyer further called on the Director of Public Prosecution (DPP) to declare that the said boy has no case to answer in the allegations.

"Writing a piece of prose/fiction on a plan to kill President Uhuru & Hon Duale ISN'T a criminal offence, for both the mens rea(mental part in planning) and the actus reus (the physical actual doing of a crime) are absent. DPP should order that no offence was committed by the boy," he posted.

Last week, Mandera police arrested the Elimu Bora student over what he wrote in his KCSE English paper in the just concluded Form four exams. 

The boy was also brought before a Mandera court on Monday this week where the presiding judge, Duncan Mtai, ordered for mental assessment of the boy before the case could proceed.
