A case challenging the election of Kitutu Masaba MP Shadrack Mose failed start on Thursday after the petitioner's lawyer failed to show up.

Shadrack Mose on August 8 won the MP seat by garnering 33,386 votes against 19,262 votes that former MP Timothy Bosire of ODM got.

A voter Justus Omiti filed a petition to challenge Mose's win on grounds that the election process was marred with irregularities.  Lawyers Stephen Ligunya and Jackson Awelle are representing Omiti in the case while Mose is represented by lawyers William Mogaka and Lazarus Mobage.

A lawyer representing IEBC Paul Lilan told Judge James Makau that his colleague Ligunya called him on Thursday to inform him he was sick and hospitalized. 

He requested the case be adjourned.

IEBC had a witness who was to testify regarding the August 8 election.

The petitioner's witness Noah Akala who is an IT expert on Wednesday failed explain how the election results were manipulated yet he is not a registered voter in Kitutu Masaba.
