The family of city lawyer Assa Nyakundi will wait longer to know his fate after Kiambu High Court Judge Christine Meoli on Wednesday disqualified herself from hearing a case.

Nyakundi is accused of shooting and killing his son under unclear circumstances. Justice Meoli recused herself from the case while citing a conflict of interest in the matter because they were classmates some time back. 

He referred the case to the Milimani law court for hearing and determination of the same.  

Justice Ngenye Macharia is now expected to mention and give further directions on the case. The case comes after the Director of Public Prosecutions (DPP) sought a directive from the court to drop the manslaughter case against the lawyer.

Nyakundi has, however, opposed the decision of the DPP to charge him with murder. He has insisted that he never took the life of his son as claimed by the prosecution. Two police officers were interdicted by the office of the Directorate of Criminal Investigations (DCI) George Kinoti over the probe of the matter.

The duo was faulted for what the DCI termed as a plot to cover the story at the expense of justice for the deceased. 

Lawyer Nyakundi had claimed that he was holstering his gun before accidentally shooting the son. 

An autopsy report, however, contradicted his claims after revealing that the son was shot at close range.

 “The angle of shooting according to the projection could be ninety degrees, suggesting there was a confrontation,” the report revealed.
