Controversial lawyer Miguna Miguna has faulted Chief Justice David Maraga following the suspension of Thika Principal Magistrate Brian Khaemba.
Miguna cited that Chief Justice David Maraga has been applying double standards after he spared Justice Njoki Ndung’u. He noted that Khaemba, who resigned moments after he was suspended, deserved better treatment.
“The JSC has suspended Magistrate Bryan Khaemba for issuing an anticipatory bail in favour of Ferdinand Waititu while on leave but Justice Njoki Ndung'u whom the JSC had accused temporary orders in favour of Tunoi when not a duty judge on May 27, 2016, wasn't suspended,” he said.
While issuing the suspension, Maraga said that the magistrate has conducted himself in an unlawful manner after he granted Kiambu Governor Ferdinard Waititu bail while he had taken a sick leave.
“Mr Khaemba conducted himself in a manner likely to suggest that he has a personal interest in the matter. It was public knowledge that Mr Khaemba was on sick leave as the same was announced to litigants during the morning briefing,” stated Maraga.
