High Court criminal division Judge Justice James Wakiaga was subjected to immense criticism following his ruling on bail application of Joseph Irungu alias Jowie on Tuesday.
In his ruling, Wakiaga dismissed the application on grounds that the applicant was a 'woman-eater', adding that his access to weapons could intimidate witnesses.
"We will start with the first accused. Is he a flight risk who is likely to abscond the jurisdiction of this court? The picture that emerges from the prosecution's evidence as set out herein above, and that the bail report of the accused, is that he is a male version of slay queen. Which, for lack of better terminology, I will call a woman-eater.
"He was living in the house of the second accused driving the second accused's car with no known source of income since 2017 when he provided security for some Jubilee politicians," he ruled.
But a number of lawyers and ordinary citizens from Nyamira have accused Mr. Wakiaga of using 'derogatory' terms in the ruling, some saying that he had preconceived mind.
Advocate David Ombego said: "I doubt this came from a judge. He has used derogatory terms besides showing that he had preconceived notions about the applicant."
Another advocate Elkana Mokua added: "He can't use woman eater as tangible reason to deny someone bail. That ground is flimsy and would be overturned upon appeal."
Mr. Irungu is now likely to remain in remand until June next year when the trial of Monica Kimani's murder will commence.
His co-accused, Jacque Maribe, was granted Sh2 million bail and subsequently barred from returning to TV screens until the matter is heard and determined.
For Moseti Moseti, the ruling was 'below average and full of discrimination', adding that the judge should review his ruling since it can't be used as precedence anywhere.
Justice Wakiaga was resident judge in Kisii from 2014 to 2015 and he served both Nyamira, Migori and Homa Bay residents at that time.
