A case pushing for power sharing between Governor John Nyagarama and his Deputy Amos Nyaribo has been determined against the latter at a Kisumu court.
Industrial and Labour Relations Judge Nduma Nderi on Thursday dismissed Nyaribo's application for lack of merit, adding that the applicant failed to satisfy the court over alleged discrimination in appointment.
"I find that the applicant failed to convince the court about alleged prejudice in appointment and governance. The case is hereby dismissed for lack of merit. The applicant to pay costs," read the ruling.
Mr Nyaribo, who argues that he had a preelection arrangement with Nyagarama, had also sued the governor at Register of Political Parties seeking interpretation.
But Governor John Nyagarama has since disputed existence of MoU, adding that he's only focused in service delivery. The county boss had accused his do of dragging him back.
"There was no such arrangements that we share government on 50:50 basis. It's a formation of someone. I never signed such a deal. Let's be focused on service delivery," he said.
The relationship between the duo has been shaky with their supporters often showing off the animosity. Mr Nyagarama insists that the Chief officers slots should be given on 50:50 basis between them.
About 17 months after 2017 polls, no substantive Chief Officers have been appointed. This, experts argue, would give some officers avenue to steal from taxpayers.
However, in March this year, the two leaders traversed the county together launching various projects. Mr Nyaribo is also recuperating after undergoing kidney transplant in India last year.
Also, Governor John Nyagarama recently tasked Nyaribo to oversee payroll purge, a move that would see several people losing their jobs. The renewed energy to work together is said to have been pushed by county senior politicians .
