Former Kitutu Masaba MP Walter Nyambati and Nyamira gubernatorial hopeful Walter Nyambati will be challenging Appeals Court ruling that upheld Governor John Nyagarama's victory on Thursday, his lawyer Osoro Mogikoyo has confirmed.

Nyambati, who was among President Uhuru Kenyatta's campaign team luminaries in Nyanza, instructed lawyers to file notice of appeal at the Supreme Court on Friday.

"Yes, I have instructions top file a Notice of Appeal at the Supreme Court on Friday morning. I have already prepared it," said Mogikoyo.

He added: "Definately some money exchanged hands and Cabinet Secretary Fred Matiang'i interfered heavily."

Last week during a fund-drive towards clearing morgue bills for Nyagarama's son in Nairobi, Matiang'i openly urged Nyambati to withdraw the case.

But Appeals Court Judge Stephen Gatembu, on behalf of the bench, dismissed Nyambati's appeal on grounds that it was defective.

The Appeals Court defeat came barely four months after Nyambati suffered a similar fate in High Court. He becomes the first gubernatorial loser to move to the Supreme Court.
