After spending close to a month as a guest of the state, Migori Governor Okoth Obado is finally a free man.
On Wednesday, Justice Jessie Lessit who is presiding over Sharon Otieno's murder case in which Obado has been implicated in, released him on Sh5 million bail.
However, his release is bound by hefty conditions imposed on him by Justice Lessit.
Apparently, he has to produce two sureties of Sh5 million each, and he is also required to surrender all his travel documents including “his Kenyan, East African and diplomatic passports which he holds”.
Further, Judge Lessit noted that the court is at liberty to cancel his bail if he breaches the following conditions:
1. He shall not cause an adjournment in the case.
2. He shall report once a month to the deputy registrar of the High Court in Milimani.
3. He shall not go anywhere within 20km within Homa Bay County boundary on all sides of that county.
4. He shall not contact directly or by proxy any witnesses in the case.
5. He shall not intimidate the parents or siblings of other people related to the deceased (Sharon Otieno).
6. He shall refrain from mentioning the deceased or the case in any gatherings or political meetings whether public or private.
Obado was arrested in mid-September after investigations by the DCI linked him to Sharon’s murder and her unborn child.
His aides, Michael Oyamo and clerk at the Migori County Assembly Casper Obiero were too arrested in connection to the murder.
Oyamo and Obiero were, however, denied bail.
The judge in denying them bail cited that releasing them could cause “fear, anxiety to potential witnesses and therefore, lead to intimidation which may adversely affect the case.”
“The likelihood of these persons absconding cannot be underrated. I also find their release is likely to disturb public order, peace and therefore public security especially bearing in mind the reaction of the public at the time of their arrest,” added the judge.
