Justices Otieno Odek and Daniel Musinga on Friday awarded ODM Sh4 billion, following an appeal launched by the Siaya senator and lawyer Julie Soweto.

“The appellant is entitled in arrears to all monies due pursuant to Section 25(1)(a) of the Political Parties Act from the financial year subsequent the effective date of the Act i.e. arrears from the 2012/13 financial year,” the judges ruled as quoted by the Standard.

In a tweet, Orengo said political parties have enumerated rights under the law, adding that Treasury has to comply with the latest court ruling.

"With my colleague Julie Soweto Aulo we got this for the party. National Treasury has to comply with clear and mandatory judicial orders. Political parties also have enumerated rights under the law. Viva ODM!" wrote the seasoned lawyer.

Appeals Court Judge Erastus Githinji had however opposed ODM's application. According to him, the party would have followed up for payment long before going to court.

Mr Orengo, who is reportedly going for Siaya gubernatorial seat, has often given ODM party pro bono. In 2017, he was the lead counsel in presidential election petition that challenged President Uhuru Kenyatta victory.

For the first time in Africa, he became the first lawyer to successfully challenge victory of a sitting president in his favour. He's been in practice for four decades.
