Brian Omondi of Thirdway Alliance did not cast his vote on Friday as it emerged that he is not a registered voter in the constituency.

According to the Independent Electoral and Boundaries Commission (IEBC), Omondi is a registered voter in Nairobi.

The case for Omondi was reminiscent of Makueni senatorial by-election in 2013 where Kethi Kilonzo was disqualified because she was not a registered voter.

She had received overwhelming support from opposition bigwigs to succeed her father after he died but a voter launched complaints with the IEBC which saw her blocked from running.

That is how her brother Mutula Kilonzo Jnr was brought on board and went ahead to win the seat.

In the Ugenya race, Omondi went ahead to accuse ODM of trying to rig the poll by planting agents in his name.

The by-election was won by Movement for Growth and Development's (MDG) David Ochieng.

Ochieng beat his closest rival, ODM's Chris Karan, by garnering 18,730 votes against Karan's 14,507 votes.

He hailed the people of Ugenya for rejecting 'the politics of big parties'.

"The will of the people can never be diverted; their wish will always emerge victorious," Ochieng said.
