Nairobi City Tycoon Paul Kobia has sued Barclays and Central Bank of Kenya for alleged threats to freeze his bank accounts.
The banks in questions threaten him if he could not disclose the source of his money.
Controversial businessman now wants the court to issues declaration to prevent Central Bank of Kenya from demanding source of money before crediting the customer's account.
Kobia argues that such acts affect customers' constitutional right to privacy and property.
Furthermore, Kobia requested the court to prevent CBK from putting in place rules that make it hard to withdraw funds unless there is an unsolved complaint.
“My constitutional rights to privacy and property will and is likely to be infringed unless the prayers sought is granted.
I and many other customers are likely to suffer a great loss if bank accounts are closed and they are restricted from accessing the funds,” said Kobia in an affidavit as quoted by Citizen TV.
As seen in a letter dated December 14, 2018, written to Kobia, Barclays Bank informed him of the decision to restrict his banking services if he won't disclose his source of huge funds.
“The customers who do not have documentary proof of the source of funds may lose their money. The regulations delay crediting of various customers’ accounts thus adversely affecting their economic and financial situation,” claimed Kobia.
