The empire of former Kiambu Governor William Kabogo is now at stake following the latest court ruling.
This is after the Land and Environment Court allowed businessman Nayan Patel to auction any property linked to the flamboyant politician to recover Sh100 million fine.
In a sitting last week, the Court under Judge Elijah Obaga also allowed the businessman to attach any property linked to Kabogo’s spouse Esther Njeri and his sons Andrew Kamau and Patrick Gichure.
The three are the directors of Caroget Investments Limited which two years ago was ordered to pay Sh100 million fine as damages after it was found guilty of fraudulently acquiring a parcel of land in Nairobi.
On October 31, 2017, the court directed Kabogo to vacate the 5.2-acre land on Mvuli Road, Westlands, valued at Sh3.5 billion after it found he had obtained its possession illegally.
“From the evidence adduced herein and the documents produced in this case, it is clear that the title by the first defendant (Nairobi County Government), which was subsequently transferred to the fifth defendant (Caroget Investment Ltd) was obtained illegally through a corrupt scheme,” said Judge Obaga in a ruling.
If Patel fails to trace and attach any property linked to Kabogo for auction, he will be allowed to apply to declare the former county boss bankrupt.
