Ousted Abakaile Member of County Assembly (MCA) Mohammed Ali Sheikh has filed another appeal at the Supreme Court just days after an appellate court quashed his appeal on Wednesday. morning.
According to court documents seen by this writer, MCA Ali Sheikh has been listed as the appellant versus four other respondents that include Abdiwahab Sheikh Osman Hathe (Applicant/1st respondent), Abdullahi Mohamed Ollow (2nd respondent) Isaac Muhumed Mohammed (3rd respondent) and the Independent Elections and Boundaries Commission (4th respondent).
While mentioning the notice, the deputy registrar of the Supreme Court revealed that the case is set for hearing on Friday 28 December 2018.
"Take notice that this matter is coming up for mention before the deputy registrar of the Supreme Court of Kenya on Friday 28 December 2018," reads the signed court documents in part.
The decision by Mohammed Ali to head to the country's apex came as a result of a ruling delivered by a five-judge bench at the Court of Appeal on Wednesday this week.
In their submission, the appellate judges rejected Ali's petition, stating that they never had any constitutional mandate to handle and determine the case.
