The Director of Public Prosecutions (DPP) Noordin Haji has dismissed claims that the arrest of Deputy Chief Justice Philomena Mwilu was meant to embarrass and demean the Judiciary.
Haji says that he ordered for Mwilu’s arrest basing on the evidence he has that implicates her in corruption deals.
The DPP, through Secretary Public Prosecutions Dorcas Oduor told court Anti-Corruption Magistrate Lawrence Mugambi that Mwilu is facing corruption charges as an individual.
He said that he respects the independence of the courts and would not wish to taint the institution.
“We respect the courts and the rights of accused persons,” he said on Friday.
The DPP maintained that he has a watertight case against the Deputy Chief justice.
Mwilu has accused DPP Haji of arresting her on orders from the executive.
In an affidavit sworn in court, Mwilu alleges that the arrest is linked to the ‘we shall revisit’ remark that was allegedly made by President Uhuru Kenyatta after his election was nullified in 2017.
Mwilu who was arrested on Tuesday is out on Sh 5 Million personal bond.
She is facing graft charges, tax evasion and abuse of office.
The DCJ’s case has however been suspended by the High court to October 9.
