A Mombasa man was on Monday arraigned in Court to answer to charges of creating a disturbance after he was caught urinating outside his wife’s shop.

Mr Simon Wachira is said to have committed the offence on October 23, at Mikindani Jomvu in Mombasa.

The 53-year-old said he urinated outside the retail shop in order to curse his wife, Margaret Mweru Njoroge.

The accused person told the court that he has been married to Ms Mweru for 32 years and he wanted to curse her after she refused to give him food.

He said on the material date, he was drunk and demanded to be given food but his wife and son refused saying they cannot feed a drunkard.

The accused said he got angry and wanted to curse his wife whom he said had moved out of their home and rented another house.

Mr Wachira further explained that he had set up the retail shop for his wife but she refused on different occasions to give him money whenever he asked for it adding that she had failed in her duties as a wife to him.

“I beg this honourable court to forgive me. I was under the influence of alcohol when I committed the offence.”

“It pained me so much when my wife, who I married legally, and my son, who I educated to university, said they could not feed a drunkard,” said Mr Wachira told Standard.

The accused person pleaded guilty to the charges before Chief Magistrate Julius Nang’ea.

Magistrate Nang’ea in his ruling found the accused guilty and ordered for him to pay a fine of Sh10,000 or be jailed for 20 days.
