An application by the Director of Public Prosecutions (DPP) Noordin Haji's application requesting to put an accused person in the attempted murder of fGarissa CeC finance executive Idris Muktar under the witness prosecution has been dismissed.
This comes after the accused Mohamud Hussein Aden stated that he was not interested in protective custody as sought by the prosecution in an application to review bond terms.
This is after Nairobi Chief Magistrate Andayi Francis directed that because the accused had already made his decision, then the recent application by the prosecution side is dismissed.
“The accused person must be protected just like any other ordinary citizen. In this case, he is an accused person and not a witness” said Andayi.
The prosecution, through the Deputy Director of Public Prosecutions Ms Catherine Mwaniki, had filed the request under a certificate of urgency seeking the court to review bail terms by putting the accused person under witness protection awaiting the conclusion of the trial.
Furthermore, the prosecution claimed the accused Mohammud Hussein Aden’s life was in danger and that he would only be safe if placed under the witness protection or in police custody pending determination of the case.
