Detectives handling the mysterious murder probe of Joseph Nyakundi, a son to renowned lawyer Assa Nyakundi, filed report even before investigations were carried out, Director of Criminal Investigations George Kinoti has said.
Already, two officers have been interdicted and could face conspiracy to defeat justice charges as Mr Kinoti stepped in to help with investigations of perhaps most dramatic crime since he took over.
Ballistic and autopsy reports, which contradicted Mr Nyakundi's statement on the death of his son, but details were not entered into the final file further raising suspicions.
“This is one of those cases I was not briefed at all by my officers,” said Mr Kinoti on Tuesday. “I only heard of the manslaughter charge from the media. Even the DPP was horrified.”
“We took somebody to court and charged him with no investigations reports at all,” said Mr Kinoti.
Detectives handling the case had pressed manslaughter charges against Nyakundi, who insists that he shot his son accidentally. But Mr Kinoti has assured the public that the city lawyer will face fresh charges.
“Once we finish the inquiry and they are found culpable, we will charge them with conspiracy to defeat justice,” Mr Kinoti said.
While Joseph was buried in Lang'ata cemetery following request by his brother Noah, Mr Nyakundi remained admitted in the hospital. Back at Gusii, the family is said to be divided following the death.
Infact, contrary to Abagusii community traditions, Noah demanded Joseph to be buried in Lang'ata, with family members saying he believes his father shot dead Joseph knowingly.
According to autopsy report, Joseph was shot from outside contrary to his father's claims. Also, the report indicates that he struggled with his assailants.
