A Kisumu family has moved to court in a bid to secure an order to bury their kin in the disputed land.

The four kin of Barrack Onunga on Wednesday appeared before Kisumu Senior Principal Magistrate Winfred Okunya with the appeal.

They said that the body has been lying in the morgue for 6 years, with all attempts to lay him to rest at the parcel of land being thwarted by James Onunga, a man who claims to own it.

They narrated how Onunga prevented the first burial with the help of the police in 2014, before exhuming the body and returning it to the mortuary in 2017, even after they secured a court order.

Jessica Ogada, the widow of the deceased, said that the land tussle saw her spend à month at the Kodiaga Prison within the county after the thwarted 2017 burial attempt.

"When we brought the body for burial, Onunga came in the company of policemen and took the body away and returned it to the mortuary,” she was quoted by the Standard.

She faulted Onunga's claims that the land is his, insisting that it belonged to the family of the deceased, where they lived until 1983 before relocating to Nandi.

The remarks were echoed by Thomas Ago, another kin, who told the court that the land has since been transferred to Onunga.

Ms Ogada said that the piece of land in question belonged to Francis Ago, Ogada's father.

The judge set the hearing for August 21, as she awaits the presentation of case documents filed in the lands court.
