A 13- year old orphan girl was defiled by a 60-year-old man named Victor Nyaenya on a diverse date between December 2018 and 20th Jan 2019 at Nyaboroba sub-location in Marani sub-county within Kisii County.

The child used to deliver milk to the defiler during school holidays. Upon delivery the culprit had a tendency of rendering favours to her like sweets, little did she know that the enticements were meant to lure her into engaging in illicit sex with him.

Later on, the shameful act was reported to Marani Police Station and the case transferred to Kisii Law Courts. Nyaenya appeared in the court on 23rd January 2019 and was charged before Stephen Onjoro (a Kisii Senior Resident Magistrate). He pleaded not guilty and was released on a bond of Sh 200,000.

The perpetrator was meant to appear again in court on 5th February 2019 for pre-trial. But to the amazement of the defiled child and her aunt (her custodian), the case was not given a hearing upon that very date.

The child’s aunt disclosed that they were informed that the magistrate and the prosecutor who were meant to hear the case were not ready on that set date. They were dismissed to go back home till a further date that they will be told.

“This is delayed justice.” Lamented the child’s aunt.

 The young girl has since not reported back to her school, Gesure Primary School because she conceived after that horrendous act. She was in Class 7.

The child’s aunt is appealing to the Government and the Judiciary to hasten in granting justice to her niece by alluding that ‘Delayed justice is denied justice’.
