A Nairobi court wants Mombasa County's Finance and Economic Planning CeC Maryam Abdillahi Mbaruk arrested and locked up for contempt of court.

This is after she failed to present herself in court and show-cause why she should not be committed to six months civil jail for failing to pay Sh37 million owed to a Mombasa car dealer. 

Justice David Majanja had issued orders directing the CeC to pay the money and further directed her to attend the court session in person. 

Murage Juma and Company Advocates filed a contempt of court application on behalf of Associated Automobiles Distributors Ltd which sued the defunct Municipal Council of Mombasa for allegedly failing to pay for five vehicles sold to them about two decades ago. 

“You are further ordered to return this warrant with an endorsement, certifying the date and the manner in which it has been executed or reasons as to why it has not been executed,” Justice John Mativo directed the police on Wednesday.

The court had also directed that the money be paid from 2004, with an interest of 12 per cent per annum. 

Associated Automobiles Distributors Ltd told the court that it sold and delivered the vehicles as per the Municipal Council’s request and order in the 1998-99 financial year and further delivered spare parts and rendered services.

Commenting on the matter, County Director of Communication Richard Chacha said the CeC would appear in court.
