Kisumu Governor Anyang' Nyong'o has withdrawn a petition at the court of appeal in an ongoing inheritance row pitting him against his two nieces.

The Governor and his sister Risper Nyagoy on Wednesday sought to withdraw a petition challenging an earlier ruling against them by the High Court, reports the Nation.

The group was seeking the delay of a ruling by High Court Judge Tripsisa Cherere in October 11, directing them to include all children of their sisters in the beneficiary list.

The case was filed by their two nieces Kenneth Okudhe and Geoffrey Omondi who went ahead to secure a win, after Cherere placed Okudhe in charge of an estate left by Nyongo's father Shimei Nyong'o.

Through their lawyers JA Geruswa and Company advocates, they wrote to the rival camp signalling their intention to drop the appeal, reports the Nation.

Shimei who did not leave a will behind before his death left a list of properties, among them tracks of land, hence the ongoing wrangles between the two.

This now means that the Nyong'o's will have to comply with the High Court's ruling.

It is, however, not clear  whether the two will also drop a contempt of court suit they have filed against the Governor and his sister after they failed to produce account books of the estates as was ordered by the court.

The timeframe within which they were to produce the books has since lapsed.
