Nyeri Magistrate Pauline Chesang has been granted Sh500, 000 bail. The magistrate was released alongside four other suspects linked to the murder of her husband Robert Chesang.
While delivering his ruling on the matter, Justice George Odunga on Friday directed the suspects to leave behind their passports.
He also directed the magistrate and other suspects to present themselves to the office of Deputy Registrar monthly as the court seeks to unmask the killer of her husband.
The family of the deceased has, however, expressed its dissatisfaction following the new development.
The kins claim that the court has not granted them justice when their relative is long dead. Waht Chesang had earlier on been denied bond before she failed a fresh application.
Through lawyer Vincent Kiptoon, the family asked the court to review the matter to ensure that justice is served at the end of the day. The family claimed that the court had not examined the matter in depth before the ruling was made.
“Real prejudice will be occasioned if this court handles this matter and that will be a compromise to the rights of the victim. The alternative court within Machakos recused itself from hearing this matter upon the application of the first accused person on the grounds of tribal and ethnic background of the judge and the deceased," state the lawyer.
On its part, the court dismissed the family’s appeal to move the murder case from Machakos. The court assured the family that the matter will be handled in a free and fair manner.
