Narok Senator Ledama Ole Kina is the latest politician to speak on Jubilee Secretary General Raphael Tuju's current woes.
Tuju has been under fire since Saturday, after a leaked phone conversation, allegedly between him and former Limuru MP George Nyanja emerged.
Allies of Deputy President William Ruto have launched an offensive on him, pushing for his resignation, over the clip, where he is being heard mocking the DP.
But Ole Kina who hails from the opposition side argues that Tuju never engaged in anything wrongful, claiming that all his alleged actions are accommodated in the constitution.
Speaking on Monday, the vocal legislator observed that the former Rarieda MP has two articles in the constitution to back his actions, therefore acquitting him of any wrongdoing.
"We have a country that is run by a very good constitution with two articles that relate to the Tuju recording matter. Article 33 touches on the freedom of expression and Article 38 which is the right for every citizen to associate himself form a political party," Ole Kina said during an interview on Citizen TV's Day Break show.
In the clip, Tuju is heard mocking the DP over his great interest in charitable functions and suggests that Nyanja should organize a fundraiser for the reconstruction of the Kiambaa church in Eldoret that was burnt during the 2007/08 post-election violence.
The two agree that they will fund the construction of the church foundation and leave the rest to Ruto, among other remarks that are not being taken lightly by Ruto's brigade.
