A Nakuru Court was on Monday forced to adjourn a case against a former county official who is facing fraud charges.

The former county deputy land registrar Madaleine Vugutsa was being charged together with Moses Njenga after their cases were consolidated in January this year.

Vugutsa who is facing charges of abuse of office was arraigned together with Njenga on charges of fraud and forgery.

According to Standard, the two were accused of allegedly forging documents for land number Njoro/Njoro Block 4/22 (BELBAR), of 5.5 acres worth Sh18,250,000.

During the case hearing on Monday, Prosecutor Bedan Kihara was to present Nakuru Land registrar Raymond Gitonye as his key witness.

Gitonye was to provide crucial documents that will ascertain the ownership of the land in question but told the court that the important documents which were part of the evidence to be provided before the court went missing in the land registrar’s office.

Gitonye asked Principal Magistrate Bernard Mararo to grant him 14 days to look for the documents which include green cards, parcel files, presentation books 790 of October 1993 and 67 of 1997.

The land registrar was also required to produce documents relating to the procurement for two parcels of land in Njoro as well as an application for the land control board and the register.

“We went to our office with the investigative officer and searched for the evidence but we have not found it up to now,” said Gitonye.
