A Kakamega man has been set free after a girl who had implicated him in a defilement case admitted that she lied, claiming that she did it on her mother's orders.

The 11-year-old girl narrated how her mother directed her to accuse Mr Maurice Muhanda of sexually assaulting her.

Mr Muhanda was charged with the crime on December 16, 2018.

The girl's mother claimed that the man ambushed the girl on her way from church and pulled her to a sugarcane farm in Rosterman village, Kakamega Central Sub County.

However, the girl on Monday told Chief Magistrate Bildad Ochieng' that her mother is not new to such and had once instructed her to accuse her uncle of a similar act.

"This is not the first time my mother has asked me to implicate a relative. There is another defilement case against my uncle that she also forced me to lie about,” she said.

She said that the mother who even claimed that she took the girl to the Kakamega County Referral Hospital for treatment always uses the tactic whenever she disagrees with someone.

“My mother has a habit of framing innocent people to get them punished whenever she disagrees with them,” she added.

In his ruling, Justice Ochieng' freed Mr Muhanda with immediate effect.

“The case is dismissed; the accused is hereby freed,” said the magistrate.
