The apex court on Thursday upheld Awiti's August 8, 2017, reelection after two nullifications by the two lower courts.

In its ruling, the court through Justice Jackton Ojwang' faulted the high and appellate courts for infringing on the rights of the Homa Bay electorate through their annulments.

"Its evident that both courts erred in their rulings and the rulings cannot stand by annulling the reflection of the respondent. We are compelled by the law to uphold the electoral rights of the electorate," he said.

"The prayer by the petitioner for a new by-election is hereby disallowed. The election results will stand as was declared by the IEBC," the court added.

In a tweet after the ruling, Amollo hailed the ruling, said that it has addressed the demand of the people of Homa Bay and that the court upheld the will of the voters.

"After 2hrs of Deep Jurisprudence, Analysis & Reasoning, the Supreme Court Upholds the Will Of The Voters In Homa Bay as Expressed on 8/8/2017. The Judgment is Lengthy, but here’s the Media Summary as Just Received," he wrote.

The petition had been filed by former Kasipul Kabondo lawmaker and Awiti's main challenger in the contest Oyugi Magwanga who insisted that he won the race.

Amollo who doubles up as the Rarieda Member of Parliament in Siaya county tackled the court alongside Siaya Senator James Orengo.
