Kitany has pleaded with the court to direct the office of the Directorate of Criminal Investigations (DCI) to probe claims that the senator was in another marriage at the time they formalised their union.

According to Kitany, the senator was married to one Mercy Kaimenyi hence had no capacity to settle down with her. She has now appealed to the court to charge the senator for falsifying information and faking documents to render the marriage nonexistent.

Kitany has also asked the court to direct the attorney general and registrar of marriages to avail all the senator's marriage records before the case can proceed to the next stage.

Through lawyer Danstan Omari, the senator has insisted that he was not married Kitany who used to work in the office of the Deputy President.

Kitany has however claimed that they got married in a colourful wedding ceremony at Linturi's home in Meru County. She further claims that the lawmaker met her family and even paid her dowry.

“That the defendant herein, if indeed did not have any capacity to marry, committed the criminal act of bigamy, an offence under Section 171 of the Penal Code of Kenya,” she said, as quoted by the Daily Nation.
