The Nakuru High Court has set a date when it will rule on an application by the Director of Public Prosecution (DPP) Noordin Haji seeking to re-open the case against Joshua Waiganjo.
Waiganjo who is facing charges of impersonating a senior police officer was charged alongside two other people.
During the hearing of the case on Friday, Justice Joel Ngugi heard the arguments from both parties, as the DPP seeks to stop the magistrate’s court from making a ruling on the case.
Justice Ngugi directed both parties to appear in court on July 31 for the ruling.
“The court has noted the arguments from both parties and will deliver its judgment,” said Justice Ngugi.
The two other accused persons in the case are former Rift Valley Provincial Police Commissioner John M’Mbijiwe and former Anti-Stock Theft Unit Commandant Michael Remi Ngugi.
The DPP in his application wants Justice Ngugi to issue orders stopping Principal Magistrate Joe Omido from closing the case without having the investigating officers testify.
The DPP accused the lower court of closing the case on August 28, 2017 without giving the prosecution enough time to present its witnesses.
M’Mbijiwe and Ngugi are facing charges of irregularly using their office to recruit Waiganjo who allegedly masqueraded as a senior police officer for more than five years.
