A crisis meeting between Judicial Service Commission and the detectives ended in disarray after Chief Justice David Maraga bowed out, reports have emerged.
Before DCJ Mwilu was arrested for tax evasion among other crimes, DPP Noordin Haji held a meeting with JSC at the Supreme Court.
"I held a meeting with Chief Justice Maraga where I notified him of our intentions to arrest the DCJ," he said.
The arrest is one of the most unprecedented and is likely to ignite political storm in the country.
A lawyer working with one of the legal firms representing Mwilu said Maraga was not 'impressed' with the manner the arrest was done.
"There were a series of meetings chaired by the CJ before his deputy was arrested.
"He was not impressed with the manner in which DPP and DCI conducted themselves. He believes that JSC should have handled the matter," he said in confidence.
After around 1 hour of intense crisis meeting, Maraga is said to have moved to his office as a sign of protest.
Earlier, Prof Tom Ojienda, who represents LSK in JSC, had also reportedly stormed out due to the nature detectives used in handling the case.
Mrs. Mwilu, who is linked with the collapse of Imperial Bank, is represented by Nyamira Senator Okong'o Mogeni, James Orengo among other high profile lawyers.
