Following the latest Court of Appeal ruling that awarded Orange Democratic Movement (ODM) a whooping Sh 4 billion, questions are now emerging if the government will comply and pay the quoted amount or if it will further redress from a higher court.
In the Friday ruling, the Appellant Court judges faulted the state for keeping ODM's accumulated Sh4 billion for the years 2011 to 2016.
The ruling was delivered by Justices Daniel Musinga and Otieno Oduk who stated that the Orange party deserved the big share despite failing to initiate a follow-up.
The ruling is now expected to deal a blow to the government that is struggling to fund her Big Four Agenda.
In the past, President Uhuru Kenyatta's government has been faulted for disobeying court orders especially those awarding monetary compensation to individuals over wrongdoings.
A typical case is that of the National Resistance Movement (NRM) leader Miguna Miguna where the state was ordered to pay him Sh7 million as compensation for torture and gross violations of his individual rights as a Kenyan citizen. To date, Miguna who was deported to Canada is yet to receive dues as awarded.
Amid the concern, the government is yet to declare stand on Friday's ruling. Similarly, the ODM party is yet to issue a statement on the same.
