Chairperson of 'Daughters of Raila' campaign group Ms Irene Mayaka will now officially assume her roles as ODM nominated MCA in the Nyamira Assembly, Justice David Majanja has ruled.

There were confusions in the county assembly last week when Ms Mayaka and her competitor, Damaris Mouni, attended assembly proceedings. They were however turned away by the assembly staff.

So unique has been their battle that Mouni, who assumed the position through 'backdoor' means according to various court judgments, has refused to accept defeat despite falling even in the Appeals Court.

"The petitioner is cleverly trying to sneak an election petition despite the period having lapsed. This petition is hereby dismissed from the court records. Status quo shall remain," said Majanja on Tuesday.

The ruling now means all formal court channels have been exhausted by Mrs Mouni, who suffered a setback last week when Speaker Moffat Teya froze all her benefits as an MCA.

Ms Mayaka will now remain the bonafide ODM nominee for gender after several months of struggle. In a text message, she welcomed the ruling and vowed to serve her constituents.

"I am attending the summit in Kisumu. I am very happy with the ruling. She was trying to buy time but the court has done it's job. It's good that this matter is now behind us."

ODM party accused Mouni of sneaking her name to Party's list prior to 2017 polls, with one of his sons then working at the IEBC found culpable of tampering with the records.
