Drama took the better part of a court session in Kwale County earlier this week, after a defilement victim pleaded with the magistrate to release the man who defiled and impregnated her last year when she was 17-years-old.
The prosecution told the court that the accused committed the offence on July 21, 2018 at Millennium area, Diani location in Kwale County.
Now 18-years-old, the complainant defended the accused as Kwale Senior Resident Magistrate Patrick Wambugu keenly listened to her.
Many wondered why she wanted her tormentor released, but she told the court that after becoming pregnant, her parents chased her away and the suspect had been taking care of her even after she delivered the baby.
“It is true the accused impregnated me after which I was chased away from home. He took care of my pregnancy and now I am 18-years-old,” she is quoted by Nation.
“If you jail this man, I will suffer greatly. I request that he be set free to help me bring up the child,” she added. She was with her baby in Court.
The magistrate had no otherwise but to set the suspect free.
“The complainant is now 18-years-old and she has attained the age of maturity. I have nothing to hold against the accused but tears of the complainant allow withdrawal of the case,” he ruled.
