Kakamega Senator Cleophas Malala is among politicians who were arrested on Friday over the killings in Matungu.
Other politicians who were also nabbed on Friday are former Sports Cabinet Secretary Rashid Echesa and Mayoni MCA Libinus Oduor. The three were released on Sunday following a directive from the Director of Public Prosecutions (DPP).
Addressing journalists after his release, Senator Malala noted that he was asked six questions during his interrogation.
"He asked me where I live and I told him I stay in Kakamega town, five constituencies from Matungu. The second question was what is your relationship with honourable Odour the MCA. The third question was what is the relationship between you and the Matungu MP. The fourth question was do you know honourable Libinus Oduor is vying for Matungu MP in 2022. The fifth question was do you know a gang called 42 brothers. The last question was do you know any rivalling gangs in Matungu," said the Senator.
Malala said he told the investigators he knew about the 42 brothers gang because it was all over the media. He, however, noted that he has no knowledge about any rivalling gangs in the area.
The lawmaker argued that the questions were shallow and shoddy, adding that they do not meet the prerequisite of a serious accusation before a court of law.
Senator Malala further said he is planning to sue the Inspector General of Police and Interior CS Fred Matiang'i for what he termed as 'political arrest'.
“I have been released unconditionally...I want to sue the IG and CS Matiang'i because I have been reliably told that they are the ones who advised the regional office to arrest us and it was purely political,” he added.
