The trial of Migori County Governor Okoth Obado, and his aides Michael Oyamo, and Caspal Obiero, over the murder of slain Rongo University student Sharon Otieno will begin on Tuesday next week.
Obado and his co-accused persons were charged in 2018, with the brutal murder of Sharon and her unborn baby.
The three pleaded not guilty to the murder charges, and spent weeks in remand before being released on bail.
Governor Obado is out on a Sh5 million cash bail with other stringent bail terms.
Last week, Oyamo and Obiero filed an application in the High Court seeking to have Justice Jessie Lessit disqualify herself from hearing the case.
The two argued that they are not guaranteed of a fair hearing if Lessit presides over the case.
They accused Justice Lessit of alleged discrimination and violation of their constitutional right to bail.
The two further accused Justice Lessit of allegedly pronouncing them guilty of the charges before the hearing of the case.
"I do not apprehend, and reasonably so, that I shall not be accorded a fair and impartial trial and I request that the case against me be presided over by any other Judge other than Justice Lessit," Oyamo says in an application filed in Milimani High court on Wednesday last week and seen by Citizen Digital.
The application to have Justice Lessit disqualify herself from hearing the case is expected to be heard next week.
Sharon's murder shocked the country, and was condemned by leaders, Kenyans and human rights groups.
