It is relief for Nairobi Governor Mike Sonko after the Employment and Labour Relations Court dismissed a case challenging the suspension of five Nairobi County finance officers.
The county boss suspended the officers saying that the officials were found in illegal possession of Sh7 million.
In his ruling, Judge Helen Wasilwa said that Sonko did not violate the constitution by suspending the officers and this will help the investigation process.
"Interdiction is indeed part of employer's disciplinary process wheel the employer is convinced that indiscipline has been occasioned by an employee.
This court has over and over again stated that it will not interfere with employers' internal disciplinary process unless the same is flawed, "ruled the judge.
The judge further noted that the decision by the five was premature.
"Whereas applicants had a right to appear before the court and seek orders as they did, I note that their quest was premature," she said.
The five who include Maurice Okere, Luke Gatimu and three others protested the decision to be investigated and prosecuted over the incident.
