Devolution and Special Programs Cabinet Secretary Eugene Wamalwa has been taken to court for allegedly failing to pay a debt owed to his former house owners.

According to former Nominated Senator Catherine Mukite, who is the house owner, the CS is yet to pay the remainder of the agreed price of the house in the posh Kitisuru estate in Nairobi, four years later.

Mukite says that Wamalwa in October 2015 agreed to pay Sh90 million for the house and paid a deposit of Sh50 million, promising to pay the remainder by Christmas of that year.

However, according to court papers, the CS, despite signing the agreement papers, has been flip-flopping paying the money which was to be shared between Mukite and her estranged husband, former Kimilili MP Suleiman Murunga.

"In contravention of the terms and conditions of the sale agreement, Mr Wamalwa failed to pay Ms Mukite and Mr Murunga the balance for the purchase price and she has only received Sh15,090,000,” the complainant's lawyer said.

She is said that the CS has been using her broken marriage as grounds to avoid paying the money, and now wants him to deposit it in their joint account.

“Wamalwa has put out the pretext that the balance cannot be paid because there are differences between Mr Murunga and me, which I believe is an excuse to buy time,” she said.

Mukite also wants the court to set out clear guidelines before she gets into an arbitration process that has been requested by the CS.
